Medwise as a Medical Device (the platform) processes natural language questions, generates natural language answers, and provides clinicians and medical professionals with recommendations for the diagnosis, treatment or monitoring of their patients. The user interacts with the platform through a browser-based user interface.

Intended use of the platform

Medwise as a Medical Device serves the purpose of providing clinicians and healthcare professionals with validated medical information through innovative AI-based technologies. The platform aims to improve diagnosis and therapeutic decision-making while saving time. It is designed to provide:

  • Diagnostic support for a broad range of medical conditions
  • Supporting medical professionals in making informed therapeutic and treatment decisions, including drug interactions, treatment protocols, and therapeutic alternatives based on the latest guidelines.

The platform may only be used by persons with medical training. Users must have the necessary specialist knowledge and qualifications to correctly interpret and apply the information provided.

Prohibited uses of the platform

The platform should not be used in any of the the following ways

  • Users should not enter any personal or patient information into the platform
  • The platform is not suitable for looking up drug information
  • The platform is not suitable for questions in dentistry
  • The platform is not suitable for questions in veterinary medicine
  • The platform is not suitable for non-medical use

Intended users

The platform is intended for use by healthcare professionals (i.e. doctors, clinicians, nurses, medical assistants, pharmacists, and other healthcare professionals involved in the diagnosis, treatment and monitoring of illnesses and injuries) in the United Kingdom only. Please do not use the platform if you are located elsewhere.

Updates to the platform

Although we make reasonable efforts to keep the platform up to date, no representations, warranties, or guarantees, whether express or implied, are extended regarding the accuracy, completeness, or timeliness of the content, or the suitability of the platform for any specific application. The platform is provided on an "as-is" basis.

Disclaimer

Medwise as a Medical Device is an experimental technology demonstrator. Information on the platform is presented exclusively for the purpose of testing novel technologies, general information, and research. It is not intended to constitute formal advice, including medical advice.

The platform does not generate patient-specific recommendations. It reflects the current state of medical science by analyzing and evaluating the relevant medical literature and guidelines in support of diagnostic and therapeutic decision-making by medical professionals. Therefore, under no circumstances should the information presented here be considered a substitute for professional advice or treatment by a clinician or qualified medical professional.

We are Medwise AI Ltd (trading as Medwise.ai), a company registered in England and Wales with number 12146414 and its registered office address at Nexus House, Discovery Way, Leeds, West Yorkshire, England, LS2 3AA (“Medwise”, “us”, “we”, “our” etc).

All users of the Medwise service (“you” etc), must follow the rules in these Platform Terms of Use (the “terms”) on how to act on the Medwise service in compliance with the law and guidance on online safety.

We may update these terms from time to time. The latest version is available at https://medwise.ai/terms.html. If you are not viewing these terms at that live link the version you are viewing may be out of date and no longer apply.

 

ARTIFICIAL INTELLIGENCE (AI) NOTICE:

The Medwise platform involves interacting with an ai interface and recommender system. Good ai governance means that we tell you this expressly (even though it may be obvious when interacting with medwise).

Although the medwise platform involves AI and automated decision-making when returning search results and generating responses, it does not make any decisions about people with legal or similarly-significant effects. Medwise provides information to support human decisions and is not a replacement for human decision making. Please see the section “do not rely on content on the platform” below for more details.

 

What's in these terms?

These terms tell you what is permitted and prohibited while using the Medwise platform ("the platform”) and apply to all users, whether you access the platform on a mobile device, via a webapp or any other method of access.

These terms include information on how we protect users from harmful or illegal content.

These terms are separate from and in addition to the formal subscription agreement (which may include a paid subscription option) which may be required to access the platform in certain circumstances. The provisions of that agreement can be found at .

By using the platform, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use the platform.

We may make changes to the platform

We may update and change the platform from time to time to reflect changes to our offerings, our users' needs and our business priorities.

We may suspend or withdraw the platform

We do not guarantee that the platform, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the platform (whether generally or for specific users or categories of users) for business and operational reasons at our discretion. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that you are the only person who accesses the platform via your connection or credentials.

How you may use material on the platform

We are the owner or the licensee of all intellectual property rights in the platform. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

No text or data mining, or web scraping

You must not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to the platform or any services provided via, or in relation to, the platform for any purpose. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the platform or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

You shall not use, and we do not consent to the use of, the platform, or any data published by, or contained in, or accessible via, the platform or any services provided via, or in relation to, the platform for the purposes of developing, training, fine-tuning or validating any AI system or model or for any other purposes not explicitly set out in the agreements that govern your use of the Platform.

This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

INFORMATION ON THE PLATFORM DOES NOT CONSTITUTE MEDICAL ADVICE

Information presented on the platform is exclusively for the purpose of testing experimental and novel technologies, general provision of information, and research. It is not intended to constitute formal advice, including medical advice.

You must review the source information and rely on your own knowledge to make clinical decisions

The primary function of the platform is to furnish information in support of human decision-making; it is not designed to supersede human judgment.

The platform is not intended for the diagnosis or treatment of any health condition, nor should it serve as a substitute for the clinical assessment and judgment of a qualified healthcare professional.

This platform is not classified as a regulated medical device

The platform incorporates experimental and novel technologies, including Artificial Intelligence (AI). AI systems are susceptible to error. Consequently, all outputs generated by the platform must be independently verified. You must review the source information and rely on your own knowledge to make clinical decisions.

Updates to the platform

Although we make reasonable efforts to keep the platform up to date, no representations, warranties, or guarantees, whether express or implied, are extended regarding the accuracy, completeness, or timeliness of the content, or the suitability of the platform for any specific application. The platform is provided on an "as-is" basis. As further detailed subsequently, we disclaim responsibility for content accessed via the platform that originates from third-party websites or other external sources.

Intended users of the platform

The platform is intended for use by healthcare professionals in the United Kingdom only. Please do not use the platform if you are located elsewhere.

We make no representations that the platform is suitable for use in, or legally compliant with the rules of, any other location or jurisdiction. All users are responsible for ensuring their compliance with legal and professional regulation applicable to their practice and making sure that their use of the platform is professional and lawful.

The platform is intended for use by individual healthcare professionals. Permission to use is granted to individual clinicians in that capacity and not to any body corporate, trust, institution or other association, whether or not having separate legal personality.

The content on the platform is intended and provided for use by healthcare professionals only. Access to and use of the platform by private individuals or consumers in that capacity is prohibited. Access and use by those under the age of 18 is prohibited.

Users indemnify us against breaches of these terms

You are liable to us for and indemnify us against any alleged or actual loss, liability, expense or claim whatsoever, that we are subject to consequent on any non-compliance by you with these terms. Your liability under this indemnity is uncapped and not subject to any exclusions of heads of loss.

This means that you are responsible to us for any damage or loss we suffer (including for example our legal and administration costs, and costs relating to an alleged but not successful claim) as a result of you breaching these terms or using the Platform other than in accordance with them. There is no limit on the sum you could be required to pay to cover our losses if you breach these terms.

We are not responsible for websites we link to

Where the platform contains links to other apps and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those apps or resources.

We are not responsible for viruses

We do not guarantee that the platform will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programs and platform to access the platform. You should use your own virus protection software.

You must not introduce viruses

You must not misuse the platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful, or otherwise harmfully interacting with the platform or any part of it. You must not attempt to gain unauthorised access to the platform, the server on which the platform is stored or any server, computer or database connected to the platform or any other equipment or network connected with the platform. You must not interfere with, damage or disrupt any software used in the provision of the platform or any equipment or network or software owned or used by any third party on which the platform relies in any way. You must not attack the platform via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the platform will cease immediately.

Which country's laws apply to any disputes?

These terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law and the exclusive jurisdiction of the courts of England.

Acceptable use

These acceptable use standards apply to any ways you use the platform.

You must comply with these standards in spirit as well as to the letter.

We will determine, in our discretion, whether any User-Generated Content or your use of the platform breaches these acceptable use standards.

You may not use the platform:

  • In any way that breaches any local, national or international law or regulation.
  • In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm minors in any way.
  • To bully, insult, intimidate or humiliate any person.
  • To send, knowingly receive, upload, download, share, post, use or re-use any material which does not comply with our content standards.
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.

How we protect you from illegal content

This provision sets out what we do to protect you from illegal content. It also explains what technology we use to help us. The latest version of our Illegal Harms Online Risk Assessment is available at: .

We minimise the length of time for which terrorism content is present on the Platform by complying with the procedures outlined in our Risk Assessment. We will swiftly take down terrorism content when we find out about it.

We will minimise the length of time for which child sexual exploitation and abuse content is present on the Platform by complying with the procedures outlined in our Risk Assessment. We will swiftly take down child sexual exploitation and abuse content when we find out about it.

We will minimise the length of time for which other content that amounts to an offence is present on the Platform by complying with the procedures outlined in our Risk Assessment. This applies to content relating to assisting suicide, threats to kill, public order offences, harassment, stalking and fear or provocation of violence, drugs and psychoactive substances, firearms and other weapons, assisting illegal immigration, human trafficking, sexual exploitation, sexual images, proceeds of crime, fraud, financial services, foreign interference, animal welfare and offences relating to being involved in committing any of these offences (known as inchoate offences). We will swiftly take down such content when we find out about it.

What content and behaviours you should report

You can report or complain about the following content and behaviours:

  • Content you consider to be illegal.
  • When you think we are not dealing with illegal content or activity as we should. You can view a copy of our most recent Online Risk Assessment at: .
  • Where you think our content reporting systems and processes do not easily let users report content they believe to be illegal and content they believe to be harmful to children and that is accessible to children.
  • When you think we have insufficiently considered the importance of protecting users' rights to freedom of expression or privacy.
  • Where your content has been taken down on the basis that it is illegal.
  • Where we have given you a warning, suspended, banned or restricted you in any way as a result of your content which we consider to be illegal content.
  • Technology we use results in your content being taken down, access-restricted or deprioritised and you think the technology has been used in a way not set out in our terms of service.

WHAT TYPES OF INFORMATION DO WE COLLECT FROM YOU?

HOW CAN YOU MANAGE YOUR MARKETING PREFERENCES?

As an individual subscriber (i.e. acting in your individual capacity) when you fill in an online form on our website or platform, you will be asked to indicate your preferences for receiving direct marketing communications from us. This will be via the ticking of a box which will be clearly marked as confirming your consent.

As a corporate subscriber (i.e. acting in a business capacity and not as a sole trader, partnership etc.), or as an individual subscriber, should you change your mind about receiving marketing communications, you can opt-out at any time by using the “unsubscribe” link at the bottom of any marketing communication that we send to you. We will always get your express consent before we share your personal information with any third party for their own direct marketing purposes.

DO WE USE ARTIFICIAL INTELLIGENCE OR AUTOMATED DECISION MAKING?

Our service uses artificial intelligence technology to interpret natural language requests, provide summaries and assist our retrieval of information functionality. We do not make any automated decisions about individuals (including any with legal or similarly-significant effects).

WHO DO WE SHARE YOUR PERSONAL INFORMATION WITH?

We may share your personal information with third parties who provide services to us, for example, our IT, communications, CRM, email and marketing automation and hosting providers. We require all third parties to respect the security of your personal information and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

The categories of data recipients we may disclose your personal information to are as follows:

HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We are committed to protecting individuals' personal information. We put in place appropriate technical and organisational measures to help protect the security of your personal information. However, be aware that no system is ever completely secure.

We have put various safeguards in place to guard against unauthorised access and unnecessary retention of personal information in our systems. These include pseudonymisation, encryption, access, and retention policies.

HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION FOR?

We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. WHAT ARE YOUR RIGHTS IN RELATION TO THE PERSONAL INFORMATION WE HOLD?

You have a number of rights under data protection laws in relation to your personal information.

You have the right to:

  • Request access to your personal information (commonly known as a "subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your personal information in certain circumstances. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your data (including carrying out profiling based on our legitimate interests). In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your right to object.
  • You also have the absolute right to object any time to the processing of your personal information for direct marketing purposes.
  • Request the transfer of your personal information to you or to a third party. We will provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
  • Request restriction of processing of your personal information. This enables you to ask us to suspend the processing of your personal information in one of the following scenarios:
    • If you want us to establish the data's accuracy;
    • Where our use of the data is unlawful but you do not want us to erase it;
    • Where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
    • You have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal information (or to exercise any of your other rights). This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
